ENGLISH BEGINS HERE
THIS RENTAL AGREEMENT (the “Agreement“) includes the conditions set out below and General Conditions, first written in the City of Montreal, Province of Quebec, Canada between the customer (the “Client”) and iParty Booth Inc. and/or La Cabine iParty Inc. (“iParty“) (collectively the “Parties“).
Whereas iParty has the photographic equipment and accessories described to the Customer who wishes to rent them;
Whereas the Parties agree to confirm their agreement in writing;
Whereas the Parties are entitled to exercise all the rights required for the conclusion and execution of the Contract;
CONSEQUENTLY, THE PARTIES AGREE AS FOLLOWS:
INFORMATION OF THE CLIENT
For the purposes of this agreement, the “Client” first mentioned above (also herein referred to as “you”, is herein referred to as the person(s) and/or organization renting photo booth equipment and/or accessories from iParty Booth Inc.
Delivery fees by Zone
Zone 1: $50 : Delivery on the island of Montreal between Aut13 and Aut 25.
Zone 2: $75 : Delivery on the island of Montreal in areas not defined by Zone1 and all of the Laval.
For delivery outside the Montreal/Laval centers, additional transportation fees will apply except if the Client uses a specific code given by iParty or their collaborators.
DURATION AND TIME
iParty Photo Booth: The rental rate is for a period of one calendar day. The photo booth is set up prior to the event at a time agreed to by iParty and the Client. The pickup by iParty occurs after the event has finished at a time agreed to by iParty and the Client. If the event is over a period longer than a day, additional charges may apply. No changes to the reservations can be made within the 30 days prior to the event.
iParty Roamer Booth: The rental rates vary depending on the length of time that is booked (see www.iPartyBooth.com/rates/. The iParty team member arrives no later than 30 minutes before the roaming booth start time indicated in this contract. This time must be arranged a minimum of 30 days prior to the event, otherwise iParty may choose its own time of delivery. No changes to the reservations can be made within the 30 days prior to the event.
It is possible for us to arrive earlier if the Client chooses the option ”additional hours”. If we arrive late for your event, we will respect the total rental time related to this contract and stay the time we missed. For example, if we are one hour late, we will stay an hour later. IMPORTANT: Our iParty Roaming Photo Booth packages are listed in consecutive hours.
iParty can stop the service or cancel an event if the weather conditions present a risk to its staff and/or equipment. Storms, strong winds or a temperatures lower than 10 degrees Celsius are some examples of weather conditions that may result in a pause or cancellation. If bad weather is forecasted, we suggest finding a space indoors. All weather interruptions will be accounted for in the rental period. No reimbursement will be issued to compensate for pauses or cancellations due to weather and the complete balance linked to the rental contract will have to be paid accordingly. Example: You booked a four hours package and the activity just started. Due to a storm, the iParty manager on site chooses to pause the activity. Two hours later, the storm is gone, and the Photo Booth activity is open again. Two hours are then left to the package and the 2 hours lost are non-refundable.
DAMAGES AND THEFT
In case of accident, The Client will be held responsible for any damages/theft or other caused by The Client and/or guests and/or event personnel during the event. The Client’s responsibility begins from the time we drop off the equipment to the time we pick up the equipment. The Client will be held to a maximum liability of 13 000$ for equipment rented. In case of damages and/or loss, intentional or not to the equipment, the cost will be calculated as follows and will have to be paid no later than the day of the event : Touchscreen 2000$, aluminum/PVC LED booth box/ring 2000$, table/skirt set-up $500, costumes/accessories 500$, backdrop kit (curtains and structure) $2000, additional lighting equipment 1000$, stanchions and red carpet $2000, photo printer 2000$ and camera 1000$. Applicable federal and provincial sales taxes will be applied on the amounts listed above. iParty will charge any amount owed due to loss/damages on the same credit card used to rent the equipment.
INTERRUPTIONS AND MECHANICAL DAMAGE
iParty will provide a functional Photo Booth for the entire rental period. During this period, it is possible that minor maintenance will be necessary.
iParty Roamer Booth: The time required for these maintenance procedures will only be added at the end of the rental period. In case of major malfunction or any other situation that would prevent iParty to provide a functional Photo Booth for more than two hours, iParty can refund your balance at a prorated amount. In case of mechanical failure that can be fixed in less than a two-hour delay, iParty can pause to repair the equipment. Pauses due to maintenance are not calculated in the rental time. If the delay exceeds two hours, the Client will have the choice between a prorated refund (see above) or a replacement with an iParty photo booth; provided there is one available. The maximum liability of iParty is only the reimbursement of the amount already paid by the Client.
iParty Photo Booth: The time required for these maintenance procedures will not affect the rental period. In case of major malfunction or any other situation that would prevent iParty to provide a functional Photo Booth for more than two hours, iParty can refund your balance at a prorated amount. In case of mechanical failure that can be fixed in less than a two-hour delay, iParty can replace the defective unit; provided there is one available. If a replacement unit is not available or if the delay exceeds two hours, the Client will receive a prorated refund. The maximum liability of iParty is only the reimbursement of the amount already paid by the Client. Delivery fees are non-refundable. Backdrop rental fees are non-refundable.
iParty Booth can use pictures and/or videos taken during the Client’s event for promotional usage on the company’s website, brochures or other forms of publicity. The Client can oppose to the usage of these photos/videos by email no later than 7 days after the event. After the 7-day period has passed, all media (photos, videos, or other) remain the property of iParty Booth Inc. The Client accepts that iParty will send promotional emails.
PHOTOS GALLERY ON THE WEBSITE
Pictures taken with the photo booth are made accessible on the company website: www.ipartybooth.com/gallery. It could take up to 72 hours for the pictures to be posted on the website. The guests will be informed of this by a sign nearby the photo booth. iParty is NOT responsible of third-party usage of the photos made available through this service. At the request of the client, the photos can be protected with a password however iParty can NOT guarantee their protection. iParty will select the photos it chooses to make available on the website. The Client can refuse this service at anytime.
PAYMENTS, REFUNDS AND CANCELLATION
Full payment is due upon reservation of equipment. The reservation is valid ONLY once iParty receives the payment and it has cleared. It is IMPORTANT to make the payment as soon as possible to ensure that one of iParty’s units and/or team member is available. If the payment has not yet cleared, iParty will not serve the Client’s event.
All sales are NON-refundable. If the Client should request to have the reservation date changed or cancelled on or before the 60th day prior to the event, only a one-time date change will be allowed, subject to inventory availability. The new date must be within 12 months of the change date. If the Client should request to have the reservation date changed or cancelled after the 60th day prior to the event, the payment will be deemed non-refundable and non-transferable to another date. The Client will not be entitled to any form of date change, compensation and/or refund
Photo Frame Design
The Client is responsible to send their photo frame design no later than 2 weeks BEFORE the event via email to info@iPartybooth.com. If iParty does not receive the Client`s design, one will be selected by iParty. If a modification is requested less than 10 days before the date of the event, additional fees may apply. The Client can have iParty custom design their photo frame by contacting iParty at info@iPartybooth.com.
An invoice will be sent to the Client 10 days prior to their event detailing the booking and amounts paid. The Client must make sure all the information is correct and request that any errors be changed within 48hours of receiving the invoice. iParty will not be held responsible for any errors.
The Client is responsible to provide:
- A 10 square foot (minimum) space free of obstacles for the installation of the iParty Photo Booth setup (if a backdrop is reserved, a minimum space of 8feet wide by 9 feet deep (72 sq.ft) is required for the setup).
- A functional standard electrical outlet 110v, 15-20amp within 20 feet of where the iParty Photo Booth will be installed
- The exact address of the event and a cell number of a person responsible on site at the event in the notes section of the booking
- Additionally, if it is an outdoor event, THE CLIENT MUST PROVIDE A CLOSED TENT OR GAZEBO type structure (with side walls) of minimal dimensions of 10×10 feet to ensure that the equipment can be operated properly.
All modifications to this contract must be done in writing and be signed by iParty and the Client.
This contract is between iParty and the Client named above in « Information of the organizer”.
